TVK Vijay | Vijay's TVK Not Recognized by Election Commission
The Election Commission of India has clarified to the Madras High Court that actor Vijay's Tamil Nadu Victory Party, popularly referred to as TVK Vijay, is not a recognized political party. This revelation came amidst a petition concerning the tragic stampede during a political rally in Karur, where 41 individuals, including women and children, lost their lives.
The petition, filed by Madurai-based lawyer Selvakumar, highlighted that gathering women and children at political events contravenes the Representation of the People Act and the Election Code of Conduct. The petition also noted that the Supreme Court has consistently upheld the cancellation of recognition for political parties involved in unlawful activities.
Legal Implications and Court Orders
Following the Karur tragedy, the Bombay High Court has issued directives prohibiting the involvement of children in political campaigns. The Representation of the People Act empowers the Election Commission to revoke recognition of parties that breach the law. However, since TVK Vijay is an unrecognized party, the Election Commission informed the Madras High Court that it cannot demand cancellation of party recognition.
Petition Demands and Compensation
The petition further requests legal action against actor Vijay and party members under the Juvenile Justice Act and the Child Labor Prohibition Act, citing negligence during the Karur rally. It also seeks a compensation of at least one crore rupees for the families of the deceased.
Court Proceedings and Guidelines
When the case was heard before a bench of Chief Justice M. M. Srivastava and Justice G. Arulmurugan, the Election Commission reiterated that TVK Vijay’s unrecognized status prevents it from filing claims for recognition cancellation. The judges have instructed the Tamil Nadu government and DGP to respond, while a special bench will be constituted to examine the guidelines for political roadshows, citing safety measures following the Karur incident.
Future Precautions and Political Accountability
The court emphasized that a single bench will oversee all matters related to drafting guidelines for political rallies and roadshows, ensuring public safety and preventing future tragedies. The Karur stampede has prompted stricter scrutiny on political events, particularly concerning the presence of vulnerable groups like women and children.
In conclusion, the TVK Vijay controversy underscores the legal responsibilities of political parties in Tamil Nadu. The Election Commission’s clarification on the party’s unrecognized status highlights the importance of adhering to electoral laws and prioritizing public safety at political events.
